Camper rental terms and conditions
The contracting parties, the renter and the lessor, confirm with their signatures on these General Terms and Conditions that they accept and agree to abide by them.
The renter undertakes to handle the rented motorhome as a good housekeeper and not to intentionally damage or expose it to risks.
1. RENTAL CONDITIONS
A motorhome can be rented by a person who:
- Provides a valid personal document with a photo proving that they are over 23 years old,
- Holds a valid driver’s license for category B vehicles for at least 3 years,
- Possesses a valid credit card or bank account card.
2. RESERVATION AND PAYMENT TERMS
- After confirming the rental period, the lessor will send the renter a pro forma invoice valid for three days. The renter agrees to pay 50% of the pro forma invoice amount within three days of receipt to confirm the reservation. Upon receipt of the payment, the lessor will issue the renter an Invoice for Payment of Reservation (advance invoice), which binds both parties.
- The remaining rental amount must be paid by the renter at least 14 days before the vehicle pickup date. For reservations where the pro forma invoice is issued less than 30 days before the expected pickup date, the full pro forma invoice amount must be paid within 3 days of receipt. If the renter fails to make payments within the specified periods, it will be considered that the renter has fully canceled the rental period.
Cancellation Conditions:
If the renter cancels the reservation more than 60 days before the motorhome pickup date, the lessor is obligated to refund 90% of the total rental cost according to the pro forma invoice or issue a 100% credit valid for 2 years.
If the renter cancels the reservation less than 60 days and more than 15 days before the motorhome pickup date, the lessor is obligated to refund 50% of the total rental cost according to the pro forma invoice or issue a 90% credit valid for 2 years.
If the renter cancels the reservation less than 15 days before the motorhome pickup date, a 100% cancellation fee will be charged or an 80% credit valid for 2 years will be issued.
If the renter is unable to travel on the scheduled date, they may transfer their reservation to another renter who meets the rental conditions, but must obtain the lessor’s consent.
For each change to an already confirmed reservation, the lessor will charge the renter an administrative fee of EUR 50.
If the renter voluntarily ends the rental early as stated in the Offer or Rental Agreement, the lessor will not refund the difference for the remaining duration (unused portion) of the motorhome rental.
The renter has the option to purchase cancellation insurance based on the received pro forma invoice, in accordance with the conditions set by the insurance company.
3. PRICE
The rental price is calculated according to the currently valid price list published on the lessor’s website and depends on the vehicle and rental period. The lessor reserves the right to change the price list.
The price includes:
- Rental of the vehicle for the agreed period,
- 22% VAT,
- Mandatory and comprehensive insurance with a 1% deductible, including additional assistance insurance,
- 400 kilometers per day of rental; excess kilometers are charged at 0.30€/km upon return of the vehicle,
- All basic equipment: electric cable and euro adapter, water hose with connector, stabilizers, chocks, and tie-down straps for the awning, hammer, and gas pliers. In winter, also winter tires, a brush, and a shovel.
- A fixed fee of EUR 145.00 is charged with each rental, covering vehicle handover costs, WC chemicals, gas, biodegradable WC paper, Slovenian vignette, exterior and interior cleaning of the vehicle, and the cost of drafting the rental agreement.
4. VEHICLE PICKUP AND SECURITY DEPOSIT
The renter will pick up the vehicle according to the agreement with the lessor, between 12:30 PM and 4:00 PM on the rental start date, and return the vehicle by 10:00 AM on the return date.
The lessor may refuse to hand over the vehicle if they detect intoxication or any other condition of the renter that is incompatible with driving in traffic.
At the latest upon vehicle pickup, the renter must pay the lessor a security deposit of €1,500. The deposit can be paid in cash at pickup or transferred to a bank account (note: banks do not operate on weekends!).
The security deposit is intended to cover potential costs that may arise during the rental period for which the renter is responsible, such as:
- Coverage of the deductible for damage claims under comprehensive insurance and loss of insurance bonus, for each claim separately. If the renter is involved in multiple damage events, they must pay the deductible for each claim, regardless of fault. In the event that the renter causes damage to a third party, the entire deposit will be automatically withheld. If it is proven in any process that the renter is not responsible for the damage, and the other participant or their insurance company reimburses the lessor for the full damage, the renter is entitled to a refund of the deductible amount.
- Repair of any damage to the vehicle or equipment.
- Coverage of potential late return fees.
- Other breaches of the contract or these general terms and conditions.
The lessor undertakes to hand over a technically flawless and cleaned motorhome with a full fuel tank, AdBlue, and a full gas cylinder, along with the equipment specified in the contract or these terms.
Upon delivery, both parties will inspect the condition of the vehicle, check the operation of the vehicle’s systems and equipment, and prepare and sign a handover protocol, which is part of the rental agreement.
The handover protocol will record any deficiencies, missing equipment, or damage to the living area, with any damage also photographed and documented. Both parties will keep the photographs until the deposit is returned or until the amount of damage and the responsible party are determined. If the renter does not keep the photographs, they cannot dispute the validity of the lessor’s photographs.
5. RETURN OF THE MOTORHOME
The renter agrees to return the vehicle on the return day, no later than 10:00 AM, to the location where it was picked up or as agreed with the lessor. Outside the high season, different agreements regarding the rental may be possible and must be documented in the Motorhome Rental Agreement; otherwise, they are not valid.
Rental extensions are not possible without prior agreement with the lessor. If timely return of the rented vehicle is not possible due to force majeure or natural disasters, the renter must notify the lessor as soon as possible.
In the event of a delay in returning the rented motorhome to the lessor of up to 1 (one) hour, a late fee of €80 will be charged. Each additional hour of delay will be charged at €180.
In case of an unauthorized rental extension of more than 1 (one) day, the lessor will file a report with the appropriate authorities and withhold the entire deposit.
Upon return, the vehicle must have:
- An empty waste and clean water tank,
- A full fuel tank (Diesel),
- An empty and cleaned WC cassette,
- A generally cleaned interior,
- A full Ad-Blue tank and a receipt proving that Ad-Blue was added.
If the above conditions are not met, the following deductions will be made from the deposit:
- €35.00 for emptying the waste water tank,
- €100.00 for emptying and cleaning the WC cassette,
- Fuel tank refill costs plus an additional €20.00,
- Ad-Blue refill at €3.00/l.
Upon return, the parties will document the vehicle’s condition in writing and check the operation of all systems. Any identified deficiencies will be recorded in the handover protocol, photographed, and billed according to the price list.
7. INSURANCE AND ASSISTANCE TERMS
All vehicles have mandatory third-party liability insurance, comprehensive insurance with a 1% deductible, and 24-hour roadside assistance.
The insurance coverage provided by the lessor is valid only within the European Union.
The insurance does not cover the transport of hazardous substances or items. Additionally, coverage is not recognized if the vehicle is operated by an unauthorized person/driver, if the driver does not have a valid driving license, or if the driver is under the influence of illegal substances that prevent safe vehicle operation, or if there is non-compliance with traffic regulations or negligence.
To cover damages to the vehicle and the deductible, as well as all other cases mentioned in point 4 of these General Terms and Conditions, the renter guarantees with a deposit ranging from €900 to €1,500, which must be fully paid no later than the day of vehicle pickup, in cash or by credit card.
The deposit is the maximum amount for one damage event. If the cost of repairing the damage to the motorhome is less than the deposit amount, a proportional share of the deposit will be retained, and the remainder will be refunded.
The renter agrees that, in the event of a damage incident (theft, wildlife, vandalism, traffic accident), they must complete the European Accident Report or provide a police report of the incident. The renter is responsible for proving the involvement of a third party in causing the damage; if they fail to prove this, the damage will be covered by the deposit.
In case of an incident, the renter should first ensure their own safety and health, and then inform the lessor, who will provide support, instructions, and guidance.
The deductible insurance covers damage that occurs:
- In a traffic accident,
- In a parking lot,
- Damage to the vehicle caused by the renter themselves or damage for which the renter cannot prove third-party fault,
- In the event of the motorhome being stolen. In case of theft, a police report is required to make an insurance claim. The renter must also have the keys and registration document with them. The insurance company will only cover costs or recognize the theft if these conditions are met.
- To the vehicle’s equipment (bike rack, awning, etc.).
BIKE RENTAL: The renter agrees that in case of theft of the rented bikes, they will call the police and notify the lessor. If the renter does not return the rented bikes, they agree to cover the full purchase value of the bikes.
All vehicles available for rent have assistance insurance.
8. CONDITIONS FOR DRIVING
The renter agrees to use the vehicle with the care of a good steward and to comply with all traffic regulations in the country of travel. The renter also agrees to cover any costs or fines that may be imposed by authorities and forwarded to the lessor as the vehicle owner. In addition to the renter, the vehicle can be driven by another driver traveling with the renter, provided they meet the rental conditions outlined in these general terms and are listed in the contract as an additional driver. By signing the contract, the renter accepts responsibility for all other drivers who operate the motorhome during the rental period.
9. BREAKDOWNS AND REPAIRS DURING THE RENTAL
The renter agrees to immediately notify the lessor of any breakdowns by calling +386 41 366 141 or +386 40 838 220, or by emailing booking@hisanakolesih.com, and to agree on the method of repair with the lessor. The renter must not attempt any repairs or alterations to the vehicle, whether to the engine or the living area, without prior agreement with the lessor.
The lessor will not acknowledge any repair costs that have not been agreed upon, coordinated, and confirmed by the lessor.
In the event of vehicle breakdowns that result in the vehicle being at a service center for 48 hours or more, the renter is entitled to a refund for the unused portion of the rental fee for the repair period. However, this right does not apply if the breakdown was due to improper use of the vehicle, a traffic accident, force majeure (such as weather damage, earthquakes, etc.), or any other reason beyond the lessor’s control. Improper use includes any usage that contradicts applicable laws or principles of good stewardship. In such cases, the renter is also responsible for covering all repair costs. Damage and air leakage from a damaged tire are not considered a breakdown, and the renter is responsible for addressing these issues.
10. HANDLING ACCIDENTS
In the event of any accident (traffic accident, theft, vandalism, etc.), the renter is required to immediately report the incident to the nearest police station, regardless of the country of travel, and also to promptly notify the lessor.
In the case of an accident involving multiple parties, the renter must complete the “European Accident Report” form and provide both the police reports and the European Accident Report to the lessor upon returning the vehicle.
If the renter fails to fulfill any of the above-mentioned or legally required duties in the event of a traffic accident or damage incident, they are liable to compensate the lessor for any resulting damages, including the payment of insurance claims if the insurance company refuses to cover the damage due to reasons caused by the renter.
11. KEYS AND VEHICLE DOCUMENTS
The renter agrees to keep the vehicle’s registration document and ignition key, as well as the key for locking the vehicle doors, with them when leaving the vehicle. This is a condition for claiming insurance coverage under the comprehensive insurance in case of theft. The renter will be liable to the lessor under general liability rules for any failure to meet this obligation.
12. LESSOR’S LIABILITY
The lessor commits to providing a technically flawless vehicle free from any defects or legal issues at the start of the rental. The parties agree that due to the nature of certain defects, the lessor may not be able to rectify all issues. The motorhome is regularly maintained according to the manufacturer’s instructions for both the vehicle and the upgrades. If the lessor cannot provide the agreed-upon reserved vehicle at the time of pickup (due to an accident, breakdown, etc.), they are required to provide an equivalent vehicle (model year, brand, equipment) or a vehicle of a higher price and quality standard at no additional cost.
The lessor assumes no responsibility for the renter’s and passengers’ property in the motorhome during the rental, including documents, money, and any equipment that is stolen, lost, or forgotten after the rental period. These items are not covered by any insurance for the motorhome.
The lessor will notify the renter by phone of any found items in the motorhome after the rental period and will keep the items for one week before discarding them.
13. CAMPING AND USE OF THE MOTORHOME OUTSIDE CAMPSITES, AND TRAFFIC FINES
The renter agrees to comply with the regulations for overnight stays or camping outside of campsites in each country they visit. The renter is responsible for all fees, fines, and charges related to incorrect or unauthorized parking or camping. In the event of the motorhome being seized by authorities, the renter must reimburse the lessor for all related costs and compensate for any loss of income if such action causes a delay in returning the motorhome to the lessor.
The renter agrees to cover all fines and penalties incurred during the rental period. The lessor is obliged to promptly forward any notifications related to fines and penalties incurred during the rental to the renter.
14. PETS
Transporting animals in the vehicle is not allowed without the lessor’s permission. The lessor may grant consent for transporting animals, and the terms related to this must be agreed upon in the contract. If the renter transports an animal in the vehicle, an additional charge of €100 per rental will apply. If the renter fails to inform the lessor that they will transport an animal or if an animal is found on upholstered surfaces (such as beds or seats), the renter will be liable for deep cleaning and chemical cleaning costs amounting to €500.
15. FREE PARKING OF RENTERS’ VEHICLES DURING MOTORHOME RENTAL
Free parking for the renter’s vehicle is available at both parking locations near Šenčur or Brnik during the rental period of the motorhome. This parking is entirely at the renter’s own risk and discretion.
The lessor and the property owners of the parking areas do not have any special or additional insurance or protection for these vehicles. The lessor will make efforts to safeguard the vehicles from damage to the best of their ability, but damage (e.g., scratches, weather-related damage, hail, etc.) is not excluded. In no case does the lessor, Soles d.o.o., bear any responsibility for repairs of such damage.
Under no circumstances does Soles d.o.o. assume any responsibility for claims related to potential damage to the renter’s vehicle parked at the address specified in paragraph 1 of this section during the rental period. The type and license plate number of the renter’s vehicle should be noted in the remarks section of the Motorhome Rental Agreement.
16. VEHICLE TRACKING
For security and easier tracking in case of theft, the vehicle is equipped with a GPS locator.
17. GENERAL PROVISIONS
The terms are written in two identical copies, each party receiving one copy.
18. PERSONAL DATA
The lessor declares that all personal data obtained from the renter or their companions for the purpose of this agreement will be carefully stored and used exclusively for the execution of the rental agreement.
By signing the agreement, the renter agrees to the use of their email address, name, and surname, as well as their country, for the purpose of informing about offers, promotions, sharing tips, and obtaining feedback.
19. DISPUTE RESOLUTION
The parties agree to attempt to resolve any disagreements and disputes arising from this agreement through mutual agreement.
The parties agree that disputes arising from this agreement will be resolved based on the terms of the Agreement and these General Terms and Conditions. Where the Agreement or General Terms and Conditions do not address the issue, the legislation of the Republic of Slovenia will apply. If the parties cannot resolve the dispute through mutual agreement, the competent court in Kranj will have jurisdiction.
